The Arabic Network for Human Rights Information said today that it has submitted a new report to the Attorney General about the enforced disappearance of the citizen “Reda Abdel Rahman” after his arrest by the security services, since last August 22 from his home in the Sharkia governorate, that is, a month ago, without submitting it to the Public Prosecution If there was an accusation against him and without announcing the place of his disappearance.

According to the family of the citizen “Reda Abdul Rahman,” on August 22, 2020, the security forces took him from his home in the( Kafr Saqr ) district in the( Sharkia governorate) and took him to an unknown destination, and did not present him to any investigating agency since his arrest until now.

The Arabic Network submitted a communication to the Public Prosecutor last Thursday, recording No. (5452) for the year 2020 “petitions of the Attorney General” regarding the kidnapping of the citizen / Reda Abdel Rahman Ali and his request to investigate the incident of his disappearance and to clarify his fate.

In its communication, the Arabic Network demanded the release of the citizen / Reda Abdel Rahman Ali and the accountability of those responsible for kidnapping him from his home, terrorizing him and his family, and not presenting him to the investigative authorities on the dates specified in the Criminal Procedure Law, according to Article 280 of the Egyptian Penal Code, which confirms that whoever has arrested or imprisoned a person or detained him without an order from one of the competent authorities in this regard, and in other cases in which the laws and regulations authorize the arrest of those with suspicion, shall be punished with detention or a fine.

The Arabic Network affirms that the Ministry of Interior continues to ignore the articles of the constitution that stipulate informing the detainee immediately of his arrest of the reasons for his arrest in writing and granting him the right to telephone his lawyer or his family, which is the key to ending the incidents of enforced disappearance, and that the prosecution's slowdown in conducting the investigation and not holding the security services accountable Violating articles of the constitution gives the green light for continuing violations of citizens' rights and freedoms.

The Arabic Network affirmed that it will continue to adhere to the application of the provisions of the constitution and the law in order to hold accountable those responsible for the crimes of assault on the freedom and personal safety of citizens, which the Egyptian constitution considers among the crimes that the criminal and civil lawsuit arising from it is not subject to the statute of limitations.

قالت الشبكة العربية لمعلومات حقوق الانسان اليوم ، انها تقدمت ببلاغ جديد للنائب العام عن واقعة اختفاء قسري للمواطن “رضا عبدالرحمن” عقب القاء القبض عليه من قبل أجهزة الأمن ، منذ 22 أغسطس الماضي من منزله بمحافظة الشرقية ، اي منذ شهر مضى ، دون تقديمه للنيابة العامة لو كان ثمة اتهام موجه له ودون الاعلان عن مكان اختفاؤه.

وطبقا لما ذكرته أسرة المواطن ” رضا عبدالرحمن” ففي تاريخ 22أغسطس 2020القت قوات الأمن عليه من منزله بمركز كفر صقر بمحافظة الشرقية واقتياده الى جهة غير معلومة وعدم عرضه على اية جهة من جهات التحقيق منذ القاء القبض عليه حتى اﻵن.

وقد تقدمت الشبكة العربية ببلاغ الى النائب العام يوم الخميس الماضي ، قيد برقم  (٥٤٥٢ لسنة ٢٠٢٠ عرائض النائب العام) بشأن اختطاف المواطن/ رضا عبد الرحمن علي ومطالبته بالتحقيق في واقعة اختفائه وإجلاء مصيره.

وطالبت الشبكة العربية في بلاغها بإطلاق سراح المواطن/ رضا عبدالرحمن علي ومحاسبة المسئولين عن اختطافه من منزله وترويعه واسرته وعدم عرضه على جهات التحقيق في المواعيد المحددة في قانون الاجراءات الجنائية، وفقا لنص المادة280من قانون العقوبات المصري التي تؤكد على أن من قبض على شخص أو حبسه أو حجزه بدون أمر أحد الحكام المختصين بذلك وفى غير الأحوال التي تصرح فيها القوانين واللوائح بالقبض على ذوى الشبهة يعاقب بالحبس أو بالغرامة.

وتؤكد الشبكة العربية، ان استمرار تجاهل وزارة الداخلية لمواد الدستور التي تنص على ابلاغ المحتجز فور احتجازه بأسباب القبض عليه كتابة ومنحه حق الاتصال التليفوني لمحاميه أو أسرته ، هو الفيصل والسبيل لانهاء وقائع الاختفاء القسري، كما أن تباطؤ النيابة في اجراء التحقيق وعدم مسائلة أجهزة الأمن على مخالفة مواد الدستور ، يعطي الضوء الاخضر لاستمرار الانتهاكات ضد حقوق المواطنين وحرياتهم.

وأكدت الشبكة العربية انها ستظل متمسكة بتطبيق نصوص الدستور والقانون من أجل محاسبة المسئولين المتورطين جرائم الاعتداء على الحرية والامان الشخصي للمواطنين والتي أعتبرها الدستور المصري من الجرائم التي لا تسقط الدعوى الجنائية والمدنية الناشئة عليها بالتقادم.
