This offensive insulting verdict to Islam….which imposes the death penalty upon the makers of that movie that disparages the prophet (peace be upon him)

This depraved judicial verdict contradicts the genuine Sunnah that the prophet (PBUH) followed
Introduction:
According to reports by “El Mesri El Youm”newspaper, dated November 29 2012, The State Security Court sentenced 7 indicted alleged perpetrators of the offensive film about the prophet, to the death penalty. The accused are Maurice Safek, Murquis Aziz Khalil, Issmet Zeqelmeh, Nebeel Adeeb Besada Mousa, Nicolai Basili, Nahid Mitwelli and Nader Ferid Fawzi. The ruling was issued with judge Seif Ennesr Suliman presiding, along with judges Mohammad Amer Jado and Hasan Isma’eel Hasan. Attending was Khaled Deya’, chief of supreme state security public prosecution office, secretary Adel Abdul Majeed. According to “El Mesri El Youm”, and after the verdict was announced, the lawyers applauded with shouts of Allahu Akber and El hemdu Lillah, an incident never before preceded in the history of Egyptian judiciary, where defense and prosecutors allied against the indicted, and a death penalty was issued in absentia for an offense listed under a charge of “contempt of religion” ….Though it is an ill-reputed law, the penalty for such an offense, is a mere jail sentence for a year or two, but never the death penalty.
Previously, the Egyptian Authorities have stripped attorney at law, Maurice Sadek off his Egyptian citizenship. Despite our great disagreement with his position and what he stands for, We at I.Q.C., issued a statement condemning the release of said offensive film, along with condemnation and rejection of the court verdict for the death penalty, because it does more harm to Islam as it contradicts its precepts, requesting of the Mufti not to validate it by signing it, otherwise who supports it becomes an enemy of Allah, glory be to Him, and His apostle. We also demanded the removal of those judges for tarnishing Egypt’s reputation and the reputation of its judicial system, as we made it clear, that such an unjust ruling, emphasizes the penetration of extremist Sunni, Henbeli Wahhabi thinking in the minds of Egyptians, and hence to defeat the Ikhwan (The brotherhood) and the Salafis politically is not enough, more dangerous is the spread of their Wahhabi religion among Egyptian Muslims. The Wahhabi infidelity should be exposed, and it is being done by the Quranists alone, without any help, not even from their victims. We concluded that statement with a promise to expose and clarify the contradiction of that judicial ruling with true Islamic law (Shari’a) , which in itself contradicts the Wahhabi Sunni Shari’a. This is part one of this clarification, titled:
This depraved judicial verdict contradicts the genuine Sunnah that the prophet (PBUH) followed
First: The meaning of Sunnah…It is the Sunnah of Allah…or the Law of Allah (Glory be to Him--GBH)
1- Sunnah has two meanings in the Quran; the method, manner or course with which Allah (GBH) dealt with the idolaters, as He related in 35:43 (Due to (their) arrogance in the land and planning of evil; and the evil planning will not encompass except its (own) perpetrators. Then do they expect, except the course of the people of afore? And you will not find in the course of Allah any change, and you will not find in the course of Allah any alteration.)….. The meaning that concerns us here is the course of Allah…the Divine law. Both expressions mentioned in the Quran are attributed to Allah…Allah says in the Quran, in a special legislation meant for the prophet alone: (33:38 there is not upon the prophet any blame concerning that which Allah has imposed for him; the course of Allah with those who have passed on before. And ever is the command of Allah a destined decree.)...In this Ayah, it is clear that what Allah had imposed, decreed is Allah’s Sunnah, meaning Allah’s Order, meaning Allah’s Shari’a, Allah’s Law…concluding that Sunnah means Allah’s Law. Which linguistically coincides with the meaning of Sunnah, you say: (Sanna) a law, meaning, he legislated a law, and by enacting it, it becomes enforceable. This also coincides with the jurisprudential meaning of the term (practical Sunnah), as in practiced, like ritual practices...i.e. prescribed prayers, prescribed alms giving, pilgrimage and fasting. All the afore mentioned practices are God decreed, as mentioned in the Quran, and the prophet (PBUH) was our example and model in carrying out what Allah had decreed. In the Quran, Allah says in 33:21 (There has certainly been for you a good example in the messenger of Allah for whoever desires Allah and the last day and remembers Allah often.)….He did not say… There has certainly been for you a good (Sunnah) in the messenger of Allah…because Sunnah is Allah’s law and decree…and the prophet is but the perfect example in carrying out God’s commands.
2- Yet they claim that this (Practical Sunnah) is nothing more than those acts of worship mentioned earlier, and that the prophet’s (verbal Sunnah) are those narrations attributed to him, centuries after his departure, traditionally known as authenticated Hadiths, which contradicts the Quran. For (the verbal Sunnah) is nothing more than what was included in the Quran ...when Allah commands the prophet to: (say)… distinguished only in the Quran, a term repeated in the Quran 332 times. The topics that included the term (say), covered what the entire believer needed in conducting his or her religious rituals, some of which re-emphasized what came down within the Quran without the word (say). The prophet was compelled to deliver all that was inspired to him, without any alteration, for he was not allowed to make up anything related to the religion off his own accord:
(69: 44 And if he had fabricated against Us some of the sayings,… 69: 45 We would certainly have seized him by the right hand, 69: 46 Then We would certainly have cut off his aorta. 69: 47 And not one of you could have withheld Us from him.)…Accordingly, the verbal Sunnah of the prophet is the word (say) in the Quran, since Sunnah is the law that we should follow.
3-They claim that those narrations were the source for knowing how to perform prayers and other rituals, and they are dead wrong. They were mere sayings, and the Sunnah is a method of performing worship, those worships were well known before Al Bukhari’s era, matter of fact , they were known before the deliverance of the Quran, for they were the principal characteristics of prophet Ibrahim’s creed which God Almighty ordered the prophet and the believers to follow….the monotheistic creed.. Moreover, those narrations circulated and collected centuries after the prophet’s departure, did not delve in detail, in what form and how to perform those prayers, rather it distorted, perverted and threw doubts around it.
4-Allah (GBH) emphasized in two verses in the Quran, that it is (The Quran) the only discourse we are to believe in:
7: 185……( Do they not consider the kingdom of the heavens and the earth and whatever things Allah has created, and that may be their doom shall have drawn nigh; what announcement (discourse) would they then believe in after this?)
77: 50 ….(.In what announcement (discourse), then, after it, will they believe?)
He even equates believing in Him (GBH) as the supreme one Deity with no partners, to believing in the Quran as His only discourse bar none:
45: 6… (These are the communications of Allah which We recite to you with truth; then in what announcement would they believe after Allah and His communications?)...let us contemplate the later part of the verse… (Then in what announcement would they believe after Allah and His communications?)...then He sternly warns those who fabricate and believe in them fabricated misleading narrations:
45: 7 Woe to every sinful liar
45: 8 Who hears the communications of Allah recited to him, then persists proudly as though he had not heard them; so announce to him a painful punishment.
45: 9 And when he comes to know of any of Our communications, he takes it for a jest; those it is that shall have abasing chastisement.
In the last commandment out of the ten mentioned in the Quran, Allah (GBH) describes the Quran as the sole straight path to be followed, excluding all others including Bukhari’s narrations and its ilk…
6: 153 And (know) that this is My path, the right one therefore follow it, and follow not (other) ways, for they will lead you away from His way; this He has enjoined you with that you may guard (against evil)
So the Quran came from God Almighty, a straight path for us to follow, and to avoid all others lest they lead us astray, it is also a hint that the Quran is the only source of Islam, for the straight path cannot be but one path, and since it is only one, and being a straight path, it must be the shortest path between two points, all other paths, rely on doubts, conjectures and uncertainties. It is well known that Hadiths (narrations) have so many different sources and so many different versions of the same Hadith, compelling scholars of Hadiths that all of it is conjectural, or as Allah (GBH) compares the Quran to everything else:
6: 116 (and if you obey most of those in the earth, they will lead you astray from Allah´s way; they follow but conjecture and they only lie)….This verse was addressed to the prophet as well as the believers.
The prophet (PBUH) followed only the Quran…. (7: 203 and when you bring them not a revelation they say: Why do you not forge it? Say: I only follow what is revealed to me from my Lord; these are clear proofs from your Lord and guidance and a mercy for a people who believe.)……also..(46: 9 Say: I am not the first of the messengers, and I do not know what will be done with me or with you: I do not follow anything but that which is revealed to me, and I am nothing but a plain warner.)…..We should follow the prophet’s suit, since we also were ordered to follow the Quran only….( 7: 3 Follow what has been revealed to you all from your Lord and do not follow guardians besides Him, how little do you mind.)…Here we have a command to do something, and a command not to do something….A command to follow the Quran and a command NOT to follow anything else, for it is the only thing immune from corruption, it was the only directive followed by the prophet, and his character was the Quran…The true Sunnah that the prophet followed was none but the Quran.
5-But they invented a man-made religion named it A-Sunnah, fabricated Hadiths and falsely attributed it to the prophet more than two centuries after his departure. This A-Sunnah contained all sorts of deprivations and offenses directed at God Almighty, at Islam and at the prophet of Islam. Out of this man-made religion and its misleading doctrine, sprang so many perverted sects, Wahhabism was its latest byproduct, and upon which, the current Saudi state was founded. It was Abdul Aziz Al Saud who planted the tree of Muslim Brotherhood and Salafism; some of its fruits are these terror groups, which founded a tremendous industry, of exploiting the religion to grab for power. Millions of Egyptians adhered to this doctrine, even by those who did not belong to the Muslim Brotherhood or the Salafis movement, among them were those same judges who were reared and brought in a corrupt media atmosphere, a corrupt educational system and a corrupt preaching environment, leading them to believe that Wahhabism is Islam, prompting them to rule according to this Wahhabi doctrine, issuing a death penalty against the movie perpetrators, thinking by doing so, they were defending the prophet and his (Sunnah), whereas by doing so, they aligned themselves with enmity to Islam and to the prophet (PBUH), for this gone-astray verdict contradicts the genuine Sunnah of the prophet, which is The Quran, and we will be coming forward with the clarification.
Second: The true genuine Sunnah in dealing with those who harm or disrespect the prophet (PBUH)
1- No matter how sever the offense committed by Maurice Sadek and his group against the prophet, it does not measure up to the level inflicted upon him by the disbelievers of Mecca. If we were to imagine that the seal of all prophets was living amongst us nowadays and saw the offensive film, he would not react to it and to them except with kind forgiveness, for that was his Sunnah, and that was his religion, since Allah Almighty sent him but a mercy to mankind…. (21: 107 And We have not sent you but as a mercy to the worlds.), and not to murder the worlds or to terrorize the worlds as his enemies the Wahhabis, the Brotherhood and the Salafis. If Allah Almighty sent the prophet as a mercy to the worlds, and the Wahhabis, the Salafis and the brotherhood spread terror in the name of Islam then who is more harming to Islam? Who is the greater enemy of Islam, Maurice Sadek and his people or Mohammad Mursi and his people?
2- Whenever, (PBUH), used to go by them, they used to ridicule him by saying…. Is this the messenger of Allah? Is this the one who dared to ill-mention our gods? Allah (GBH) recorded their ridicule in the Quran …..(21: 36 and when those who disbelieve see you, they do not take you but for one to be scoffed at: Is this he who speaks of your gods? And they are deniers at the mention of the Beneficent Allah.)… ( 25: 41 And when they see you, they do not take you for aught but a mockery: Is this he whom Allah has raised to be an messenger?)…He went to threaten them with Hellfire..(18: 106 Thus it is that their recompense is hell, because they disbelieved and held My communications and My messengers in mockery.)
3- By repeating the commands to him to be patient, we understand that their harassment was unbearable, though he (PBUH) was the highest in character, in attributes in compassion and in tolerance, but their extremism in harming and hurting him, was beyond human capacity to withstand, that is why the command to be patient came down one after another… (73: 10 and bear patiently what they say and avoid them with a becoming avoidance.)….meaning to distance his self from them gently, to avoid them with kindness…this is perseverance and patience towards harm accompanied by high caliber morality and character, since their promised abode is hellfire. Allah says in the Quran (73: 11 and leave Me and the rejecters, the possessors of ease and plenty, and respite them a little.)…( 73: 12 Surely with Us are heavy fetters and a flaming fire,)…( 73: 13 And food that chokes and a painful punishment,)…It used to pain the prophet (PBUH) to hear them fabricating stories about him, to hear their accusations….his tolerance starts to wane, his Lord would tell him..( 16: 127 And be patient and your patience is not but by (the assistance of) Allah, and grieve not for them, and do not distress yourself at what they plan.)…( 16: 128 Surely Allah is with those who guard (against evil) and those who do good (to others))…( 6: 33 We know indeed that what they say certainly grieves you, but surely they do not call you a liar; but the unjust deny the communications of Allah.)….To rid himself of this feeling , being uptight, feeling their pressure etc.., Allah (GBH) commands him to immerse himself in more worship, more prayers, until God’s relief materializes…(15: 97 And surely We know that your breast straitens at what they say;)…( 15: 98 Therefore celebrate the praise of your Lord, and be of those who make obeisance.)…( 15: 99 And serve your Lord until there comes to you that which is certain.)…The command is repeated again as the verbal assault resumed or intensified….(38: 17 Bear patiently what they say, and remember Our servant Dawood, the possessor of power; surely he was frequent in returning (to Allah).)…( 20: 130 Bear then patiently what they say, and glorify your Lord by the praising of Him before the rising of the sun and before its setting, and during hours of the night do also glorify (Him) and during parts of the day, that you may be well pleased)…( 50: 39 Therefore be patient of what they say, and sing the praise of your Lord before the rising of the sun and before the setting.)…( 50: 40 And glorify Him in the night and after the prayers.)…His Lord even warns him not to let his anger overtakes his patience…(30: 60 Therefore be patient; surely the promise of Allah is true and let not those who have no certainty hold you in light estimation.)
All this leads us to believe that the prophet’s Sunnah (PBUH) is patience and perseverance, with the continued and repeated extreme aggression, and to reciprocate it with acts of worship, remembrance of God Almighty and entrusting everything to Him (GBH)>>>>and not with the death penalty.
4-This perseverance is not a negative one, associated with weakness, grudge, and hatred or taking revenge from those unjust perpetrators, rather it is a positive one, based on forgiveness, peace, leniency and kind tolerance for the aggressor, as in what God Almighty commanded him to do...… (73: 10 and bear patiently what they say and avoid them with a becoming avoidance.), here the becoming or suitable avoidance is the same as a kind becoming forgiveness, as in...( 15: 85 And We did not create the heavens and the earth and what is between them two but in truth; and the hour is most surely coming, so turn away with kindly forgiveness.)..The Hour that surely is coming, is coming with the punishment for them, so it is better for you to forgive them with no hatred or grudge, it is enough what is in wait for them. This concept was reiterated in (43: 88 Consider his cry: O my Lord! surely they are a people who do not believe.)...(43: 89 So turn away from them and say, Peace, for they shall soon come to know.), it is turning away from them accompanied by well-wishing of peace, for the Day of Reckoning will come when they will know for sure.
5-This legislation is for us too, and not restricted to the prophet (PBUH), since God Almighty orders us to return the aggressor’s enmity with peace...( 25: 63 And the servants of the Beneficent Allah are they who walk on the earth in humbleness, and when the ignorant address them, they say: Peace….( 28: 55 And when they hear idle talk they turn aside from it and say: We shall have our deeds and you shall have your deeds; peace be on you, we do not desire the ignorant)….This is a legislation for us, if we were true believers, and not unbelieving Wahhabis , Salafis or hypocrites, to forgive those who do not believe in Allah or do not work toward the Judgment Day, (45: 14 Say to those who believe (that) they forgive those who do not fear the days of Allah that He may reward a people for what they earn.)….( 45: 15 Whoever does good, it is for his own soul, and whoever does evil, it is against himself; then you shall be brought back to your-- Lord.)…He commands us to forgive them, and to be in wait for the final judgment, on us and on them, on that Day… What contradicts this directive is when some assume the role of God Almighty and condemns those who differ with him on matters of religion to death, pretending to be a Muslim…..we ask, who then does more harm to Islam?
6- This is high standard of ethical conduct, in kind words and not by murder…As for those who commit aggression through murder, then both man-made law and Divine law allow for self defense. Here we stress that this high standard of ethical conduct is inseparable from the genuine Islamic Shari ‘a that the Wahhabis, the Brotherhood and the Salafis renounce through their actions. For the Islamic principle of enjoining justice and benevolence …(16:90Surely Allah enjoins the doing of justice and the doing of good (to others) and the giving to the kindred, and He forbids indecency and evil and rebellion; He admonishes you that you may be mindful.) Justice in case of aggression is exacting the same in punishment. He who strikes you for unfounded reasons, you have the right to strike him back. Benevolence is to forgive when you are in a position to exact punishment, Allah (GBH) explains this concept in ..(42:40. And the recompense of evil is punishment like it, but whosoever forgives and amends, he shall have his reward from Allah; surely He does not love the unjust.).An evil act is returned in the same fashion, that s justice, but to forgive and amend, for Allah’s sake and pleasure, it is benevolence. The prophet (PBUH) was commanded not only to return an evil deed with a kind one, but rather with a better one..(23: 96. Repel evil by what is best; We know best what they describe.).This is a state of excellence not achieved by believers except those with a great measure of faith and piety, attained only by true followers of the genuine Sunnah of seal of all prophets. Allah (GBH) addresses us and all believers in the Quran ...(41: 33. And who speaks better than he who calls to Allah while he himself does good, and says: I am surely of those who submit?)…(41: 34. And not alike are the good and the evil. Repel (evil) with what is best, when lo! he between whom and you was enmity would be as if he were a warm friend.)…(41: 35. And none are made to receive it but those who are patient, and none are made to receive it but those who have a mighty good fortune)…Meaning, We return an evil act with a better act, this way the opponent, the aggressor might feel the guilt of his action, and in turn becomes a close friend.
Conclusion….
1-We end this article with the news that Mohamad Mursi, The Brotherhood president, declared December 15th 2012 as the date for a referendum on the Wahhabi Constitution, drafted by the founding committee, which considers the Wahhabi Shari ‘a that contradicts Islam , as the principal source of legislation in Egypt. Almost everyone is expecting the outcome of such referendum to be an exact replica of those preceded it, where the will of the ruler will prevail….meaning the Saudi Wahhabi Shari ‘a will be forced upon Egyptians in the name of Islam…
2-Will the Quranists remain the only ones facing the Brotherhood, the Salafis, the Saudis and the rest of those Wahhabis?
3- Is there no shame left out there?
